Resolution in Support of a special exception for 3909 Huntington Street NW in BZA Case No. 19612
Whereas, Elizabeth Boison (the “applicant”) has an application pending for a special exception from the required 25 foot rear yard requirement to instead construct an addition with a rear yard of 23.04 feet from the Board of Zoning Adjustment (the “BZA”) for her property located at 3909 Huntington Street NW (square 1754, lot #915) in BZA Case No.19612, and
Whereas, the ANC has reviewed the plans, presented at a fully noticed public meeting, and Whereas, the applicant has shared their plans with all of the immediately impacted neighbors all of whom support such plans, and
Whereas, in past cases similar to this the ANC has strongly encouraged applicants to save as much of their properties’ green space and trees as possible and the plan proposed by the applicant does not require the removal of any trees and minimally impacts the lots green space, and
Whereas, the applicant has committed to adding a rain barrel to offset the modest loss of permeable surfaces, and
Whereas, the property currently has a non-conforming rear yard of 23.04 feet and the applicant is planning to extend the non-conforming rear yard to cover the width of the home and to add an additional story to a portion of the rear of the home that is non-conforming and the ANC considers the proposed addition to be reasonable, particularly since it is consistent with the existing non-conforming use.
Now therefore be it resolved, ANC 3E supports the application for a special exception from the Board of Zoning Adjustment provided the BZA places a requirement for the use of the rain barrel in its order approving the proposed addition at 3909 Huntington Street NW in BZA Case No. 19612.
ANC 3E approved this resolution at its meeting on October 12, 2017, which was properly noticed and at which a quorum was present. The resolution was approved by a vote of 4-0-0. Commissioners Jonathan Bender, Greg Ehrhardt, Jonathan McHugh and Tom Quinn were present.
